Can I sue a company on eBay for selling me a fake phone?


I recently broke my Samsung Galaxy S5, so I decided to buy another one on eBay. It came in the post 30 minutes ago, and when I opened the box and looked over the phone I realised it was fake. The screen has been super glued on and the screen is noticably smallet than it should be. The call speaker on the front of the phone is poorly put in and the charging port is bigger than it should be. Also, the device is stuck on 4.4 and won't update to the latest version so it looks cheap and tacky unlike the S5 and the camera quality us equivalent of a potato. So I contacted the seller and explained that I would happily send it back for a full refund. If they don't however, could I sue them?
